Aylor Farm has a sales contract for all of our puppies. This ensures the health, safety and happiness of our puppies when going to their forever homes. Our Sales Contract states:
"Breeder" - me
"Puppy" - listed puppy on first page of contract
"Buyer" - person buying the puppy
BREEDER RESPONSIBILITIES:
Breeder warrants that Puppy is healthy at the time of sale to the best of Breeder's knowledge. Breeder will have had Puppy checked over by her veterinarian before Puppy is picked up by Buyer. Any minor defects or abnormalities will be documented and discussed as an addendum to this contract and mutually agreed on prior to buyer acquiring Puppy.
BUYER RESPONSIBILITIES:
Buyer has 3 days (not business days) from the date of pick up from the breeder's house, to have Puppy examined by a licensed veterinarian to affirm that Puppy is in good health. This is for
the protection of both Breeder and Buyer.
If Buyer does not take Puppy to a veterinarian within 3 days (not business days, but 3 days total) then the Buyer cannot return Puppy for a full refund due to any illness.
It is the responsibility of the Buyer to maintain the health of Puppy after it has left the Breeder's premises. This health warranty does not include accidents, injuries, illnesses, or poisonings that have occurred after Puppy has left breeder’s possession.
Buyer will not take Puppy to any public places or let Puppy interact with any other dogs
(unless that dog lives within the same household and is up to date on vaccinations) until the vet check is performed. Parvovirus and Distemper are extremely contagious and often found in high-traffic pet areas including: vet offices, dog parks, pet stores, etc. Carrying the Puppy while in the vet’s office is strongly recommended. Limit Puppy's exposure to these areas until after 12 weeks of age and received appropriate vaccinations.
If Puppy is found to be ill, the Breeder reserves the right to have Puppy checked over by the Breeder's veterinarian before a refund is given. If the Breeder's veterinarian concurs with
Buyers veterinarian, then 100% of the purchase price will be refunded to the Buyer. Buyers must
return Puppy to Breeder within 3 days of vet check in order to qualify for refund.
The Breeder is not responsible for veterinary bills resulting from Buyer's vet check or veterinary
treatment of Puppy at any time after Puppy has been turned over to Buyer. Again, the Puppy will be cleared by breeder’s veterinarian before leaving to its new home.
Our Dam and Sire have been health tested. This does not guarantee that Puppy is exempt from acquiring any health issues later on in life. It means that the parents are healthy, and the probability of having an affected offspring has been drastically reduced. We want our puppy buyers to be aware that, although we've done our best to make sure we are producing healthy puppies/dogs, sometimes health problems happen regardless.
FIRST RIGHT OF REFUSAL:
Buyer agrees that at no time will they sell, give, trade, lease, adopt, place, or re-home Puppy to any person, business or organization without notifying the breeder. Breeder has the first right of refusal to purchase the puppy back, for no more than the total that the puppy was sold for excluding the nonrefundable deposit and travel expenses to get the puppy back to Breeder. If Breeder chooses not to buy back the puppy, the Buyer will not sell/flip the puppy for more than the original purchase price. Buyer also needs to provide Breeder with the new Owner’s information so we can keep track of where our puppies are. This keeps our puppies out of shelters or bad situations such as being dumped or flipped.
RESERVATION OF RIGHTS:
Breeder reserves the right to enforce this contract in order to protect the welfare of Puppy.
The Buyer further expressly agrees that the Breeder may repossess Puppy upon any evidence of neglect and/or abuse or upon any breach of this agreement, at no expense to the Breeder and with no refund of any monies to the Buyer. If the Breeder does ask for Puppy to be returned to the Breeder, due to neglect and/or abuse, Puppy shall be returned within 24 hours by the buyer.
VACCINES/VETERINARY CARE:
Puppy is up to date on vaccinations and deworming at the time you receive him/her. It is
important that your puppy receive additional vaccinations necessary to keep it protected against infectious canine diseases. The Breeder is not responsible for any communicable diseases or reactions from vaccinations.
NUTRITION/GROOMING:
Buyer agrees to feed a premium quality food or raw diet for the life of the dog. Grooming is also important to keep Puppy in healthy condition.
HEALTH GUARANTEE:
The Breeder warrants a 12 month health guarantee from the date of birth of Puppy. This refers to any disease that would cause the Puppy to not live a normal life as a companion/pet. This does NOT refer to any diseases/conditions that can be maintained with medicine or surgeries, or diseases/conditions common in the breed, such as, but not limited to, Cherry Eye, Grade 1 Patellar Luxation, Entropion, Distichia, PRA. If something were to pop up that causes the Puppy not to live a normal life, the Puppy will be replaced with another puppy of equal value as soon as one becomes available. If the Puppy dies within the first year of life, a necropsy must be performed by the state to confirm Puppy died from a genetic issue. If you fail to comply, there will be no compensation. NO REFUNDS will be given unless agreed upon between Breeder and Buyer. At no time will shipping, delivery, veterinary expenses be covered. Shipping/delivery cost are the Buyer’s responsibility.
While we guarantee healthy puppies at the time they go home, puppies are susceptible to parasites and a lot of puppies are born with worms. Common parasites in puppies include roundworms, tape worms, hookworms, whipworms, Coccidia, and Giardia. We have a deworming schedule in place to eliminate parasites from your puppy. Due to the life cycle of these parasites, it is impossible to guarantee your puppy is parasite free. We always recommend getting a fecal test done on your puppy for intestinal parasites at their first vet visit to continue treatment if needed. Taking precautions such as keeping your puppy off public land where other dogs infected feces may be, providing clean water, keeping your puppy’s crate/living area cleaned, finishing your puppies’ recommended vaccinations/deworming schedule will help avoid any re-infestation of the above parasites. The aforementioned conditions listed above are not covered under our health guarantee and no refunds or exchanges will be given.
HEALTH WARRANTY PROVISIONS:
All warranties are non-transferrable and are valid for the original buyer only.
All veterinary expenses incurred by the buyer, after Puppy has left the breeder's possession,
are the sole responsibility of the buyer. No refunds or monetary reimbursements will be given for the veterinary care.
Abnormalities caused by accidents, injuries, improper diet, unhealthy weight, owner negligence,
and excessive exercise is not covered by warranty.
REMINDER REMINDER REMINDER & MOST IMPORTANTLY:
We will always take back our dogs/puppies. We never want our dogs/puppies put into a dangerous situation or into a shelter. As a rescue/foster myself, shelters are overrun with dogs as is. It's my responsibility as a breeder to keep the dogs/puppies I produce out. They will always have a place here. I will do the work of evaluating them and finding a home that deems suitable.
